Referrer Agreement

Our referrers are very special to us. We work hard to treat you with the fairness and respect you deserve. We have written the following referrer agreement to help you better understand the program.

This Agreement contains the complete terms and conditions that apply to you becoming an referrer in Strategic Business Enterprise Referrer Program. Throughout this Agreement, "we," "us," "sbe" and "our" refer to Strategic Business Enterprise, and "you," "your," and "yours" refer to the referrer.

THIS IS A LEGAL AGREEMENT BETWEEN YOU AND STRATEGIC BUSINESS ENTERPRISE. BY SUBMITTING THE AFFILIATE SIGN UP FORM YOU ARE AGREEING THAT YOU HAVE READ AND UNDERSTAND THE TERMS AND CONDITIONS OF THIS AGREEMENT AND THAT YOU AGREE TO BE LEGALLY RESPONSIBLE FOR EACH AND EVERY TERM AND CONDITION.

Commissions
​
You earn $250 for each person you refer that apply and get approved for one of our loan products. Generally all our referrals are paid within 30 business days. Referrals are required to submit a copy of their voided check and W-9 form before they can receive commissions.

Taxes
​
If you will earn more than $600 within one year, you may be subject to pay taxes. You are required to pay all Federal and States taxes or any required taxes on the money you earn.
​
Commission Enhancement
​
Each referrer will have the option access to our promotional tools that’s 99% effective in helping you earn commissions. After you find a lead you will submit the required information in the Referrer Portal. We will approve the lead within 48 hours. We will send out a approval notification to you.
​
Stats and Tracking
​
After you make your first commission, we will begin sending you monthly commission reports via email. We use your Referrer ID for tracking all your commissions. You must provide your Referrer ID in the Referrer Portal when you are submitting your lead information.

Promotion Restrictions
​
A great way to promote our services is by using our promotional tools. You are allowed to cold call the telemarketing list that we provide. Some of prohibited forms of advertising include the use of unsolicited commercial email (UCE), postings to non-commercial newsgroups and cross-posting to various newsgroups together. Furthermore, you are not allowed to advertise in any way that may improperly misrepresent your identity, your domain name, or your return email address. You may run email campaigns to customers to market our product and services but the recipient has to already be a customer or subscriber of your services or web site, and recipients must be able to unsubscribe from the emails. Also, you may post to newsgroups to promote our product so long as the news group specifically welcomes commercial messages. You are restricted from spamming. We will consider spamming an immediate ground for termination of this Agreement and your involvement in our Strategic Business Enterprise Referrer Program. This will also terminate all your payments.

STRATEGIC BUSINESS ENTERPRISE MAKES NO EXPRESS OR IMPLIED REPRESENTATIONS OR WARRANTIES REGARDING STRATEGIC BUSINESS ENTERPRISE SERVICE AND WEB SITE OR THE PRODUCTS OR SERVICES PROVIDED THEREIN, ANY IMPLIED WARRANTIES OF STRATEGIC BUSINESS ENTERPRISE ABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT ARE EXPRESSLY DISCLAIMED AND EXCLUDED. IN ADDITION, WE MAKE NO REPRESENTATION THAT THE OPERATION OF OUR SITE WILL BE UNINTERRUPTED OR ERROR FREE, AND WE WILL NOT BE LIABLE FOR THE CONSEQUENCES OF ANY INTERRUPTIONS OR ERRORS.

Representations and Warranties

You represent and warrant that this agreement has been duly and validly executed and delivered to you and constitutes your legal, valid, and binding obligation, enforceable against you in accordance with its terms.

Limitations of Liability

WE WILL NOT BE HELD RESPONSIBLE FOR ANY CONCERNED MATTER OF THIS AGREEMENT UNDER ANY CONTRACT, NEGLIGENCE, TORT, STRICT LIABILITY OR OTHER LEGAL OR EQUITABLE THEORY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF REVENUE OR GOODWILL OR ANTICIPATED PROFITS OR LOST BUSINESS), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. FURTHER, NOTWITHSTANDING ANYTHING TO THE CONTRARY INCLUDED IN THIS AGREEMENT, IN NO EVENT SHALL STRATEGIC BUSINESS ENTERPRISE’S CUMULATIVE LIABILITY TO YOU ARISING OUT OF OR RELATED TO THIS AGREEMENT, WHETHER BASED IN CONTRACT, NEGLIGENCE, STRICT LIABILITY, TORT OR OTHER LEGAL OR EQUITABLE THEORY, EXCEED THE TOTAL COMMISSION FEES PAID TO YOU UNDER THIS AGREEMENT.

Indemnification

You agree to indemnify us of your acts and omissions. You agree to indemnify, defend, and hold Strategic Business Enterprise harmless and any of their referrals or anyone who work under Strategic Business Enterprise. They shall be held harmless from any and all third party claims, losses, liability, damages, and/or costs (including reasonable attorney fees and costs) arising from your interactions with the site, your breach of Terms or intellectual property infringement , or breach of Terms or intellectual property infringement by any other user of your account. We will inform you accordingly of any such claim, loss, liability, or demand, and will provide you with reasonable support, at your expense, in defending any such claim, loss, liability, damage, or cost.

Confidentiality
​
All confidential information, including, but not limited to, any business, technical, financial, and customer information, submitted by one party to another during negotiation or the implicit term of this Agreement which is marked "Confidential," will be considered the sole property of the party that's releasing information , and both parties will keep in confidence and will not release information of the other party without authorization of the disclosing party.

Miscellaneous
​
You agree that you are an independent contractor, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between you and Strategic Business Enterprise. Each party is restricted from assign its rights or responsibilities under this Agreement to any party, except to a party who obtains all or substantially all of the business or assets of a third party. This Agreement shall be governed by and interpreted in accordance with the laws of the State of Louisiana without regard to the conflicts of laws and principles thereof. You are not allowed to modify any part of this Agreement unless each party to signs a modification notice. This Agreement constitute the agreement between us and you, and shall govern all previous agreements and communications of the parties, oral or written. If any clause of this Agreement is held to be invalid or unenforceable, that provision shall be removed to the minimum extent necessary such that the intent of the parties is effectuated, and all other parts of this agreement shall remain effective.

Modification
​
We may modify any of the terms and conditions in this Agreement at any time at our sole discretion. In such event, you will be notified by email.
