BINDING EFFECT

 

This is a binding agreement between the user ( you, visitor) and ’ Strategic Business Enterprise’ (”us”, ”we”, company). By using the Internet site located at custom url (the ”site”), you agree to comply these Terms of Use. If you find it difficult to abide with these Terms, you must refrain from visiting and using the Site right away.

You fully understand that we may present any information that you provide to us (i) Strategic Business Enterprise’s affiliates, lenders, agents or loan providers; (ii) to the credit bureaus and services that may be benefit for your company; (iii) to any other individual or organization with your acknowledgment; or (iv) if we have an obligation to disclose such information or are authorize or mandated to so for legal purposes . We value your privacy and our most recent privacy policy can be observed on our website. 


GOVERNING LAW

 

These Terms of Use shall be construed in accordance with and governed by the laws of the State of Louisiana in the United States, without reference to rules regarding conflicts of law. The site is intended for use by individuals who live in United States.

 

EMAIL COMMUNICATIONS

 

By using the Site you expressly permit and agree to receive email correspondence from us. These email response may be non-commercial that help us to serve you better. Some examples of non-commercial are administrative issues and notifications of changes to these Terms, the Privacy Policy or other site reference guides.

Buyer Protection Program

This program is to protect all our buyers and customers. If you need a refund, you can reach out to us via email at strategicbusinessenterprise@mail.com within 120 days of the payment made.

 

When payments are made to us the money is put in our Escrow. The money is put there in case we may need to issue a refund to a customer. We ask that you store all reference numbers in safe places just in case.

 

You are entitled to a guaranteed refund as long as:

 

The refund is within 120 days of the payment

You can provide us with proof of payment

The issue is can't be resolved from our end

 

If the refund is approved by our Disputes Team, it's automatically deposited back to your payment method immediately. It may take 3-5 business days for the funds to be available to you.

 

If the refund is disapproved we give you the right to file a dispute with our Mediation Team. Our Mediation Team will look at the issue into more depth. They will make another decision within 1-2 business days to approve the refund.

DATA SERVICES

All our data are 90% verified and contain no duplicates. We used a state of the art technology to verify our data real time.

The delivery may vary depending on the volume of  records. Data in the range  of  30000 records will be delivered within  1- 3 days. A range of 60000 records will be delivered in 4- 7 days. Volumes higher than 60000 may take longer than 7 days to deliver. All data will be delivered in an excel or cvs file.

If you find an invalid rate higher than 11%  or duplicate leads in our marketing lists, we will kindly replace those leads with verified leads although you will never need that.

If the court system find specific terms and conditions in these Terms of Use that are not enforceable, then the remaining terms and conditions in the Terms of Use will be effective and enforceable. No waiver of any breach of any provision of these Terms of Use shall constitute a waiver of any prior, concurrent, or subsequent breach of the same or any other provisions hereof, and no waiver shall be effective unless made in writing and signed by an authorized representative of the waiving party.

 

AMENDMENTS

 

We reserves the right to amend these Terms. Should we seek to make such an amendment, which we determine is material in our sole discretion, we shall:
(a) Provide you notice by email of said change 15 days prior to the change going into force, or
(b) Make a post on our website announcing when the amendment will be made. If the court system find this Amendment provision ineffective, then this Amendment clause shall be disregarded. All other amendments to the Terms shall remain enforceable.

 

Digital Millennium Copyright Act Policy

Strategic Business Enterprise respect the intellectual property rights of others just as we expect others to respect our rights. Pursuant to Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c). An agent from Strategic Business Enterprise is able to receive notification of alleged copyright infringement that occur. 

 

To submit a notification of alleged copyright infringement to us, you must provide us with the information listed below. It is a requirement for the notice to be in written form.

Notice of Infringement – Claim

1. Your physical or electronic signature
2. Identification of the copyrighted work claimed to have been infringed;
3. Provide a description of the material that is claimed to be infringed and give us information to help us locate the infringed material. You may also submit the URL of the page in question to assist us in identifying the allegedly offending work.
4. Provide the copyright owner’s name, physical address, email address, phone number, and fax number.
5. Provide a statement that the complaining party has a good faith belief that the use of the material is unauthorized by the copyright agent.
6. Provide a statement that the information in the notification is accurate, and, under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.
Title 17 USC §512(f) provides civil damage penalties, including costs and attorney fees, against any person who knowingly and materially misrepresents certain information in a notification of infringement under 17 USC §512(c)(3).

Please note that we may share the identity and information in any copyright infringement claim we receive with the alleged infringer. In submitting a claim, you understand accept and agree that your identity and claim may be communicated to the alleged infringer.
Counter Notification – Restoration of Material
If you have received a notice of material being takedown because of a copyright infringement claim, you may provide us with a counter notification in an effort to have the material in question restored to the site. Said notification must be given in writing to our DMCA Agent and must contain substantially the following elements pursuant to 17 USC Section 512(g)(3):
1. Your physical or electronic signature.
2. A description of the material that has been taken down and the original location of the material before it was taken down.
3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which the address is located (or if you are outside of the United States, that you consent to jurisdiction of any judicial district in which the service provider may be found), and that the you will accept service of process from the person or company who provided the original infringement notification.

Repeat Infringer Policy


We take copyright infringement very seriously. Pursuant to the repeat infringer policy requirements of the Digital Millennium Copyright Act, we maintain a list of DMCA notices from copyright holders and make a good faith effort to identify any repeat infringers. Those that violate our internal repeat infringer policy will have their accounts terminated.
